PAIN MANAGEMENT WITH NARCOTICS:
POTENTIAL MEDICAL, FINANCIAL AND DEA RAMIFICATIONS

Physical Medicine and Rehabilitation [PM&R] specialist, Dr. Ira Kornbluth will discuss the challenges of managing the chronic pain patient with narcotics. Dr. Maria Sciame will discuss the increased percentage of claim costs for medications in relation to the age of the claim. The DEA representative, Mark Malcolm, will discuss what happens when these pharmaceutical drugs find their way into street sales.

"THE 800 POUND GORILLA IN THE ROOM"

A claimant's pre-existing psychiatric condition can impact a workers' compensation claim at every stage of the case, complicating treatment, claimant's relationship with his attorney, return to work issues and eventual permanency exposure. Occupational Psychiatrist Dr. Brian Schulman will answer questions posed by attorneys for the claimant as well as the employer/insurer on causation, treatment and how to avoid allowing this 800 pound gorilla to control the claim.

HOW THE LEARNING DISABILITY LABEL CHALLENGES THE WORKERS' COMPENSATION PROCESS

Learning disability is an umbrella diagnosis which may involve congenital, environmental, educational, medical, and psychiatric factors, individually or collectively. Whether it is due to increased attention, recognition, or wider use of assessment tools, the number of workers compensation cases involving learning disabilities is increasing. This discussion will include the challenges presented by' the learning disability diagnosis on the procession and resolution of workers' compensation claims.

A REVIEW AND CURRENT UPDATE

Leading expert, James E. Pocius, Esquire negotiated the Medicare set-aside guidelines with Centers for Medicare and Medicaid Services (CMS). Mr. Pocius will discuss the steps to take to avoid settlement disasters with regard to reporting and how he believes reporting will affect both liability and workers' compensation settlements. Learn what new litigation could be forthcoming concerning penalties for failure to abide by the reporting requirements.
